Terms of Service

1. Acceptance of Terms

By accessing or using ToyHuntr ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, collectors, and contributors of content.

2. Description of Service

ToyHuntr is a mobile application that helps toy collectors organize, track, and discover collectible items. The Service includes collection management tools, item tracking, pricing research, gamification features, convention tools (RADR), and optional community features through Syndicate.

Syndicate is ToyHuntr's optional social layer. When you opt in, it includes the Feed (posts, comments, and reactions), Discover (search, trending, and leaderboards), Messages (direct and group chat, including convention group chats), and related notifications. You may use Hunt, Collections, RADR, and other non-social features without joining Syndicate.

The Service may also include optional features such as barcode scanning, photo-based search, AI-assisted identification or metadata suggestions, and integrations with marketplaces or catalogs. Availability of these features may depend on your subscription or account type and may change over time.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. User Content

4.1 Your Content

You retain ownership of any content you upload to the Service, including photos, collection data, profile information, and Syndicate posts, comments, messages, and reactions. By uploading content, you grant us a license to use, store, display, and distribute that content as necessary to provide the Service, including showing Syndicate activity to users who follow you or participate in the same conversations, subject to your privacy settings.

4.2 Content Restrictions

You agree not to upload content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains harmful, offensive, or inappropriate material
• Contains malware, viruses, or other harmful code
• Is spam or unsolicited promotional material
• Uses Syndicate as a marketplace (buying/selling offers or commercial solicitation in the feed or messages, outside of ToyHuntr's designated features)
• Includes hate speech, harassment, threats, nudity, sexually explicit material, graphic violence, illegal activity, impersonation, doxxing, or knowingly false information about products, prices, or other users

4.3 Community Standards (Syndicate)

Before using Syndicate, you must read and agree to ToyHuntr's Community Standards in the app. By using Syndicate, you agree to keep content hobby-related, treat other huntrs with respect, and follow the standards presented at opt-in, including restrictions on marketplace activity, hate speech, explicit content, spam, impersonation, and sharing others' personal information without consent.

Violations may result in content removal, Syndicate access restriction, or account suspension. ToyHuntr's moderation decisions are final.

4.4 Content Moderation and Reporting

We may review, modify, hide, or remove any content that violates these Terms or is otherwise objectionable, at our sole discretion. Syndicate content may be reviewed using automated tools (including AI-assisted moderation) and human review. If you see content that violates our standards, use the in-app report option on posts, profiles, or messages.

4.5 Syndicate Access

Syndicate requires explicit consent through the in-app Community Standards gate. If you do not agree, you may continue using non-social ToyHuntr features. We may restrict or revoke Syndicate access for users who violate these Terms or Community Standards without refund of unrelated subscription fees, except where required by law.

5. Premium Features and Subscriptions

ToyHuntr offers premium features available through in-app purchases and subscriptions. Subscription terms, pricing, and features are subject to change. Subscriptions automatically renew unless cancelled.

Refunds and cancellations for subscriptions purchased on iOS are handled according to Apple's App Store policies. Contact Apple Support for subscription-related refunds on Apple platforms.

Refunds and cancellations for subscriptions purchased on Android are handled according to Google Play policies. Contact Google Play support for subscription-related refunds on Google Play.

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by ToyHuntr and protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written permission.

7. Third-Party Services

The Service may integrate with third-party services including, for example, Firebase (Google), eBay (listings and image-based search where offered), OpenAI (AI-assisted or photo-based features where offered), Google Gemini (automated Syndicate content moderation where offered), and ToyHub or similar catalog providers (barcode or figure data where offered). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

8. Disclaimers and Limitation of Liability

8.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

8.2 Pricing Information

Pricing data provided through the Service is for informational purposes only. We do not guarantee the accuracy of pricing information and are not responsible for decisions made based on such information.

8.3 Limitation of Liability

To the maximum extent permitted by law, ToyHuntr shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless ToyHuntr, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the app or via email. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ToyHuntr operates, without regard to its conflict of law provisions.
